Terms of Service

Welcome to PinMe. Please read these Terms of Service (“Terms”) carefully before using the PinMe application (“the App” or “the Service”) operated by the PinMe Development Team (“we”, “us”, or “our”).

By downloading, installing, accessing, or using PinMe on any PWA-compatible browser, iOS device, or Android device, you agree to be bound by these Terms. If you do not agree to all terms, you must immediately delete the App and refrain from utilizing our Services.

1. Description of Service

PinMe is a minimalist geofencing and location-based reminder application. It allows you to create virtual circular zones on a map and attach local text reminders that trigger when you enter or leave those zones. The Service is provided under two tiers:

• Free Tier: Enables basic features including 1 active geofence area and 1 active reminder stored locally.
• PinMe Pro: A paid subscription tier enabling unlimited active geofenced areas, unlimited text reminders, and secure cloud synchronization powered by Supabase to make your configuration available across multiple devices.

2. User Accounts and Verification

While basic functions are available locally on your device, cloud synchronization features require you to create an account with a valid email address and password. You are solely responsible for keeping your login credentials confidential and for all actions taken under your account. You agree to notify us immediately of any unauthorized access to or use of your credentials.

3. Location-Based Permissions

To execute reminders successfully in the background, PinMe requires you to grant system-level location permissions (specifically “Always Allow” background coordinates access on mobile devices) and notification delivery permissions. You understand that:

• Background location access is processed locally by your operating system's native geofencing APIs to check your coordinates against the shapes you draw.
• If you disable location services, background execution, or notification rights, geofenced triggers will fail to activate or alert you.

4. Billing, Subscriptions, and Cancellation

Subscriptions to PinMe Pro are billed on a recurring monthly or annual basis.

• Purchasing: Transactions are handled directly via the Apple App Store, Google Play Store, and managed through RevenueCat. We never collect or store your payment card credentials.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle unless you disable auto-renew in your device's subscription management panel at least 24 hours before the current period ends.
• Refunds: All purchase transactions and refund requests are governed by the billing policies of the respective platform stores (Apple App Store or Google Play Store). We cannot issue refunds directly.

5. Acceptable Use and Restrictions

You agree to use the App solely for legal, personal tracking and reminder purposes. You must not:

• Install the App on a device you do not own or control to track the movements of another individual without their explicit, ongoing consent.
• Attempt to reverse-engineer, exploit, scrape, or disrupt the operation of the App or its database connections.
• Use the App in a manner that creates excessive load on our databases or Supabase endpoints through automated script actions.

6. Data Ownership and Deletion

You retain full ownership of all geofence zones, notes, and messages you create in PinMe.

We provide an immediate account deletion mechanism inside the application (under Reminders → Account → Delete Account). Triggering this action permanently, immediately, and irreversibly deletes your authentication record, geofence coordinates, radii, and reminder logs from our databases.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND.

You acknowledge that geofence alerts rely on background GPS accuracy, cell towers, Wi-Fi networks, and mobile OS process limitations (such as background task killing or sleeping). We do not guarantee that reminders will trigger immediately, accurately, or at all. You should not rely on PinMe for critical, life-saving, or time-sensitive events (such as medical alerts or dangerous environments).

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE PINME DEVELOPMENT TEAM, ALVARO FERRER RIZZO, OR ITS INFRASTRUCTURE SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES arising from (i) your access to or use of the Service; (ii) the failure of any geofence trigger or alert; or (iii) unauthorized access to your synchronized account data.

9. Intellectual Property

The PinMe logo, code architecture, graphical interface, design system, and text content (excluding user-created geofence text) are the exclusive intellectual property of Alvaro Ferrer Rizzo and the PinMe team. You are granted a limited, personal, non-exclusive, non-transferable, and revocable license to run the App.

10. Governing Law

These Terms shall be governed, construed, and enforced in accordance with the laws of the developer's jurisdiction, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved in the competent courts of that jurisdiction.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will update the effective date at the top of this page. Continued use of the App following any changes indicates your acceptance of the updated Terms.
